Migrant Workers’ Rights Under Fire in Fiji

The chairperson of the Fiji Human Rights and Anti-Discrimination Commission (FHRADC), Pravesh Sharma, has declared that it is illegal for Fijian companies to retain the passports of migrant workers. He expressed concern over a rising number of complaints from these workers, highlighting troubling situations where individuals have been abandoned on the streets when conflicts arise between employers and employees.

Speaking with The Fiji Times’ online platform, The Lens@177, Sharma emphasized that all employers in Fiji who recruit migrant workers must adhere to both the 2013 Constitution and the international agreements Fiji is part of, which safeguard the rights of these workers and their families. He noted that some local employers are jeopardizing these rights by withholding workers’ passports.

Sharma pointed out that passport confiscation acts as a controlling mechanism, preventing workers from leaving the country or seeking alternative employment when disputes occur. “No one should hold anyone’s passport,” he stressed, advocating for the basic principle that individuals should retain possession of their own documents.

Migrant workers frequently report issues related to inadequate housing, non-payment of wages, and poor living conditions. Sharma reassured that the FHRADC is actively addressing these grievances, often achieving resolutions through negotiation with employers. He reminded stakeholders that the earnings of migrant workers significantly contribute to their families back home, highlighting the broader implications of these workers’ treatment.
