Chief Registrar Tomasi Bainivalu has urged former Deputy Commissioner of the Fiji Independent Commission Against Corruption (FICAC), Francis Puleiwai, to refrain from emulating the actions of the Prime Minister, key opposition figures, or media representatives when filing complaints against legal practitioners. In a direct communication accessed by FijiLive, Bainivalu emphasized the importance of maintaining the independence of his office, which is responsible for handling public grievances involving legal professionals.

Bainivalu expressed his concerns, stating, “I ask that you do not make a mockery of the legal system by copying all your complaints to the media, the Honourable Prime Minister, and senior members of the Opposition. I cannot understand that.” He reassured Puleiwai that her complaint would be treated with respect and in the same manner as those previously lodged.

The nature of the complaint appears to focus on FICAC Commissioner Barbara Malimali, who is being accused of misconduct related to the unlawful issuance of a Stop Departure Order. Puleiwai claimed that Malimali’s actions appeared to be intentional despite the absence of any active investigation against her. She also referenced Section 10G(1) of the FICAC Act 2007, asserting her immunity from any legal repercussions related to her conduct.

Puleiwai pointed out that the Stop Departure Order remains operational within the Immigration System and has not been annulled despite recognized procedural mistakes.

The plea for respect towards the legal system reflects a commitment to uphold its integrity while ensuring that genuine concerns are addressed appropriately.
