The High Court’s decision regarding an application from three government officials, who are contesting the admissibility of prosecution evidence on the grounds that it constitutes hearsay, has been postponed until Monday. Justice Usaia Ratuvili was expected to announce the ruling at 10 am, but a notice outside the courthouse indicated that the case will now be addressed on Monday.
This case involves former health minister Dr. Neil Sharma, former prime minister Voreqe Bainimarama, and former attorney-general Aiyaz Sayed-Khaiyum. All three have been charged with abuse of office, obstruction of justice, and breach of trust related to alleged transactions that occurred in 2011.
Wylie Clarke, president of the Fiji Law Society and the attorney representing Dr. Sharma, is challenging the validity of the prosecution’s tender evaluation report and its minutes based on hearsay.
The postponement reflects the ongoing complexities of the legal proceedings and emphasizes the importance of ensuring that due process is observed in such significant matters concerning public officials.
