The High Court has overturned a 13-month prison sentence with a three-month non-parole period for Farina Bi, who was convicted of assaulting her de facto partner. Bi had entered a guilty plea on February 10, 2025, for an incident that occurred on January 30, wherein she allegedly assaulted the victim after he rejected her advances, resulting in physical injuries such as bruises and a laceration on his upper chest.

Dissatisfied with the original ruling from the Magistrate’s Court in Lautoka, Bi appealed her conviction on March 19, claiming that the magistrate did not adequately explain the implications of her guilty plea. However, High Court Justice Aruna Aluthge dismissed the appeal concerning the conviction as it lacked merit. Nevertheless, Bi’s appeal regarding the sentence was partly successful; the High Court substituted the original sentence with a reduced imprisonment term of six months, effective from the date of the original sentencing.

This case echoes broader discussions around domestic violence, an issue highlighted in previous cases, including one where a mother was sentenced for pouring hot water on her partner. Such incidents reveal ongoing societal challenges regarding domestic violence and the judicial system’s efforts to balance punishment with rehabilitation.

With legal systems increasingly focusing on victim protection and offender accountability, there is hope that a cultural shift toward non-violence and respect in relationships can be fostered.
