A jury has delivered a significant ruling in favor of former All Whites goalkeeper Jake Gleeson, awarding him NZ$35.7 million in damages following a medical malpractice case against his former team doctor. The lawsuit stemmed from complications that arose after a back surgery intended to treat stress fractures in both of his legs, which ultimately derailed Gleeson’s football career in 2018.

During the procedure, it was alleged that the surgical plates used in Gleeson’s legs were not properly sterilized, leading to severe infections in both legs. This resulted in Gleeson undergoing 14 subsequent surgeries and suffering from chronic pain that prevents him from walking comfortably. At the time of the incident, he was a player in the Major League Soccer for the Portland Timbers.

Almost five years ago, Gleeson filed the suit against Dr. Richard H. Edelson, with the defense arguing that the sterilization method used, known as Immediate-Use Steam Sterilisation (IUSS), was adequate, and that infections are an inherent risk of surgery. They did not reveal their intentions regarding an appeal after the jury’s decision.

Gleeson expressed the emotional and physical toll the last few years have had on him, indicating the profound impact this experience has had on his life. He noted that he wanted to advocate for better doctor guidelines and policies, emphasizing that every patient, regardless of their status, has the right to proper care and safety measures during medical procedures.

This case aligns with the broader dialogue around the necessity of informed consent in medical practices, as highlighted by recent similar legal battles regarding patient rights. For instance, another case was ruled in favor of a patient who underwent surgery without proper consent, underlining the importance of trust between healthcare providers and their patients.
