The Suva Magistrates Court has approved the state’s request to transfer the case involving former Prime Minister Voreqe Bainimarama, former Attorney General Aiyaz Sayed-Khaiyum, and former Health Minister Dr. Neil Sharma to the Suva High Court. The court date is set for January 26, 2025. This follows the vacating of a previously scheduled trial date in August.
During today’s proceedings before Magistrate Sufia Humza, Bainimarama is charged with one count of abuse of office, while Sayed-Khaiyum faces one count of abuse of office and one count of obstructing justice. Dr. Neil Sharma has also been charged with abuse of office. The allegations against all three defendants center around their supposed failure to comply with the statutory requirements outlined in the 2010 Procurement Regulation.
Dr. Sharma is specifically accused of neglecting tender regulations during his tenure as Minister of Health, favoring a bidder named Hospital Engineering & Consultancy Ltd, also known as Hospineer. This alleged breach occurred between August 3 and September 13, 2011, as well as in subsequent incidents in October of the same year, where it is claimed he acted in a way that undermined other competitors.
This case highlights ongoing concerns regarding governance and integrity within Fiji’s public service. The transfer of the case to a higher court reflects the seriousness of the charges and the judicial system’s commitment to addressing misconduct in public office. As the defendants prepare for their upcoming hearing, many in the community will be hoping for accountability and transparent justice as the legal process unfolds.
