A married man is seeking bail due to concerns about being detained with individuals infected with HIV, but he has not provided sufficient evidence to support these fears. The accused is facing serious charges of raping a woman in her 20s after allegedly providing her with a massage at her home on November 1, 2023. During his bail hearing before Justice Pita Bulamainaivalu, his lawyer argued that the man fears for his health and safety, particularly from potential exposure to HIV, which he claims could occur if pressured to share needles with fellow remandees.
Court records detail that the woman, who suffers from back and stomach pain, sought the accused’s professional services as a masseur. However, during the massage, he allegedly began to make inappropriate physical contact and subsequently forced her into sexual intercourse against her will despite her attempts to resist. Following the incident, the victim reported the assault to her boyfriend.
While the accused maintains that no sexual misconduct occurred, the prosecution has presented evidence contradicting his claims. State lawyer Unaisi Ratukalou highlighted that the accused had not raised his health concerns during his time in the remand center, and if he had, the corrections officials would have taken appropriate measures. She emphasized that if his life was truly at risk, he should have been more specific about his claims.
