Nawaikula’s Legal Battle Continues: Appeal Hearing Scheduled

Former parliamentarian Niko Nawaikula’s appeal against the decision by the High Court to dismiss his constitutional redress application is scheduled for a hearing. The case was brought before Judge Justice Pita Bulamainaivalu.

Earlier this year, Mr. Nawaikula sought constitutional redress concerning a magistrate’s actions, which he alleged were unduly influenced by the late former Chief Justice Kamal Kumar, leading to an unfair transfer of his case to the High Court. His application was ultimately unsuccessful, resulting in an order from Justice Bulamainaivalu requiring Mr. Nawaikula to pay $2,000 to the Attorney-General’s office. Furthermore, FICAC, as an interested party, was not granted costs due to the unique circumstances surrounding the case.

Judge Bulamainaivalu commented that Mr. Nawaikula’s appeal to the Court of Appeal represented alternative remedies to his initial constitutional redress, characterizing the action as an abuse of the court process. The hearing for the appeal is set to commence on February 14 of the following year, with both parties instructed to submit their documentation by January 13.
