The Labasa High Court has decided to grant immunity to Muqtadeer Saif Kaiyum, a key figure in the complex legal proceedings against lawyer Amrit Sen. This development is critical as it allows Kaiyum to act as a state witness. This decision follows the prosecution’s submission of a nolle prosequi, seeking to formally release Kaiyum from the charges as a co-accused.

Sen, who is representing himself, alongside Simione Valenitabua, the counsel for Shumedha Chandra, expressed strong objections. They argue that Kaiyum’s involvement in defense strategies compromises the integrity of the legal process. Despite these concerns, Justice Pita Balemainaivalu sided with the prosecution, highlighting their right to call Kaiyum as an immunised witness. This move is part of their strategy to strengthen the case against the defendants.

Kaiyum’s original charges were related to conspiracy, while Chandra is also facing charges of conspiracy and assault causing bodily harm. The most severe charges lie with Sen, who is implicated in the murder of John Rusiate, also known as John Pelo, dating back to June 2022. This case has garnered significant attention, reflecting larger issues of legal integrity and ethical practices within the region’s judicial system.

Justice Balemainaivalu has emphasized the need for cooperation from all parties. With 37 witnesses yet to testify, he stressed the importance of avoiding unnecessary delays to ensure the trial proceeds smoothly. This case is set to continue in the Labasa High Court, with proceedings scheduled for the following day.
