The Public Service Disciplinary Tribunal has mandated the Ministry of Finance to reinstate Ashwin Nand, a civil servant previously suspended due to multiple misconduct charges. Nand faced accusations of carrying alcohol in a government vehicle and forcibly entering the vehicle of the Assistant Minister of Finance, with incidents occurring between December 2023 and February 2024.
In its ruling, the tribunal instructed the ministry to formally reprimand Nand and to clearly denounce his inappropriate conduct, which included alcohol consumption during work trips, damaging a colleague’s phone, and failing to attend scheduled meetings, while also lacking courtesy and respect towards fellow employees. The tribunal emphasized the importance of maintaining workplace standards and warned that any future misconduct could lead to termination.
While Nand is required to resume his duties within a week from December 20, 2024, the tribunal also decided that his salary would be forfeited for the period after May 29, 2024.
This decision highlights the balance between disciplinary actions and the opportunity for rehabilitation in the public service sector. By reinstating Nand with a written reprimand, the tribunal underscores the importance of second chances while simultaneously reinforcing accountability in the workplace.
