Justice Delayed: Former Digger Driver Faces Rape Sentencing in Shocking Case

A former digger driver, aged 46, who was found guilty of raping his 11-year-old stepdaughter, had his sentencing hearing postponed to April 14. Justice Waleen George delivered the verdict last week, convicting the man on two counts of rape and one count of sexual assault while acquitting him of criminal intimidation.

The offenses took place regularly at night from January to April 2022, coinciding with the victim’s mother working late shifts. Allegations against the accused included threatening to poison the young girl with paraquat and making violent threats against her family. Justice George noted that the prosecution’s claims of criminal intimidation were not sufficiently established, as there was no corroborating evidence to support the alleged threats to the victim’s family.

The prosecution is represented by Pooja Mishra from the office of the Director of Public Prosecutions. This case emphasizes the critical importance of legal processes in protecting vulnerable individuals, particularly minors, from predatory behavior.
