High-Stakes Legal Drama: Fiji’s Former Leaders Under Scrutiny

Assistant Director of Public Prosecutions Laisani Tabuakoro has submitted a formal request to transfer the case of former Prime Minister Voreqe Bainimarama and former Police Commissioner Sitiveni Qiliho to the High Court. Bainimarama faces a charge of making unwarranted demands as a public official under Section 355 of the Crimes Act 2009. The allegations state that between May 21 and August 18, 2021, he pressured Rusiate Tudravu, a former senior police officer, to terminate two police officers—Penieli Nayare Ratei and Tomasi Naulu—or resign if he failed to comply.

Meanwhile, Qiliho is charged with two counts of abuse of office, stemming from his decisions to overturn disciplinary actions taken against Naulu and Ratei, which included penalties that were considered lenient. Qiliho allegedly terminated these officers’ employment instead of upholding the original disciplinary measures.

The case is attracting significant attention due to the high-profile nature of those involved, raising discussions about accountability and ethical governance in Fiji. The state motion aims for the substantive case to be evaluated by the High Court, with defense lawyer Devanesh Sharma requesting additional time to prepare a response. The hearing will reconvene on April 11, and the trial is scheduled from June 2 to July 11, 2025, involving approximately 30 witnesses.

The plea from the court and the attention it has garnered demonstrate the strong public interest in upholding governance standards.
