The High Court in Suva has scheduled a hearing regarding the strike-out application brought by Neelraj Sharma, the former Director of Public Prosecutions. This application pertains to a significant compensation claim of $800,244 million initiated by Veronica Malani against eleven individuals involved in investigations related to an alleged bombing case from 1987.
All legal representatives attended a session before Justice Usaia Ratuvili at the High Court on Wednesday. During the session, Sharma’s attorney, Ronal Singh, announced their readiness to proceed with a hearing date. However, Malani was granted additional time to ensure her attorney, Sitiveni Raikanikoda, could be present.
Justice Ratuvili subsequently established December 11 as the hearing date, directing all involved parties to submit their documents prior to this date. Raikanikoda raised concerns about the defense’s adherence to civil procedure protocols, pointing out that none of the defense lawyers had filed a statement of defense after being served with the writ of summons, opting instead to file a strike-out application immediately.
Raikanikoda also inquired about the legal representation of retired Police Commissioner Rusiate Tudravu and retired Assistant Police Commissioner (ACP) Crime Biu Matavou, who are listed as the fifth and sixth defendants. He questioned their representation by the Office of the Attorney-General, suggesting they should have independent legal representation and submit their own responses given their inclusion in the lawsuit. Justice Ratuvili noted that the trial would proceed regardless of their attendance.
