The Government has announced that it will not be appealing the recent High Court ruling regarding Barbara Malimali. In an official statement, the Government acknowledged the court’s decision and expressed gratitude to the Judiciary for its careful and independent adjudication of the case.

After consulting with legal advisors and President Ratu Naiqama Lalabalavu, the Government chose not to challenge the High Court’s outcome. The statement emphasized that while the original decision was based on legal advice from a respected King’s Counsel, the Government respects the Court’s ruling.

This ruling serves as a reminder of the vital role the Judiciary plays in ensuring justice and fairness for citizens, reinforcing the robustness of Fiji’s legal framework and the principle of separation of powers. The Government also recognized the constitutional authority of the Judicial Services Commission (JSC) in reaching a resolution on this matter, as indicated in the court’s judgment.

Prime Minister Sitiveni Rabuka reiterated the Government’s confidence in Fiji’s democratic institutions, asserting the administration’s dedication to principles of good governance, accountability, and the independence of the judiciary, as well as the balanced distribution of power among the Executive, Legislature, and Judiciary. This decision reflects a commitment to upholding justice while fostering trust in the nation’s legal system.
