The Fiji Government has announced that it will not appeal a recent High Court ruling in the case involving the former Commissioner of the Fiji Independent Commission Against Corruption (FICAC). This decision marks the government’s dedication to upholding the rule of law and judicial independence in Fiji.

In an official statement, the Government expressed its appreciation for the careful and independent adjudication provided by the Judiciary in the case referenced as HBJ 5/2025, Barbara Malimali v The President of Fiji and Others. The decision to forgo an appeal followed consultations with the President and was made after careful legal consideration.

The Government acknowledged that the original decision, which was subject to judicial review, was based on senior legal advice but emphasized its respect for the Court’s findings. This indicates a significant development in the relationship between the Government and the Judiciary, highlighting the importance of judicial oversight in the nation’s governance.

In its statement, the Government noted that the High Court’s ruling underscores the critical role of the Judiciary in maintaining justice and ensuring fairness for all citizens. It reflects the integrity of Fiji’s legal framework, which is designed to separate powers within the government and protect judicial decisions from political interference.

The Government also expressed its commitment to adhere to the next steps that the Court has outlined. This includes acknowledging the constitutional authority of the Judicial Services Commission to deliberate on the case and move towards its conclusion.

Prime Minister Sitiveni Rabuka reiterated the government’s confidence in Fiji’s democratic institutions, affirming its dedication to good governance, accountability, and the separation of powers among the executive, legislative, and judicial branches. This commitment signals a hopeful path toward strengthening the rule of law in Fiji, ensuring that the principles of democracy remain intact and upheld for the benefit of all citizens.
