Prime Minister Sitiveni Rabuka has opted not to comment on his communications with the Commission of Inquiry (COI) regarding the suspension of FICAC Commissioner Barbara Malimali, following a legal opinion that affirms the authority of the Judicial Services Commission in such matters. Rabuka, in an interview with FijiLive, stated that he does not wish to be implicated in any situation that might be viewed as an abuse of power.

In light of Malimali being placed on leave yet still actively vetting evidence for the COI, Rabuka remarked, “She is accountable for every word she speaks,” indicating that her responsibilities remain intact despite her leave status. He emphasized that his recommendations based on the King Counsel’s opinion do not impact any individual.

The Prime Minister also refrained from discussing Malimali’s potential removal, noting that this decision lies within the scope of the Judicial Services Commission. His commitment to avoiding any misuse of authority was clear as he stated, “I am not going to be drawn into an issue or area that could amount to an abuse of my power or authority.”

The complexity surrounding Malimali’s leadership at FICAC reflects ongoing concerns about governmental oversight and legal integrity. Rabuka has previously indicated that the independence of the COI must be maintained. He has expressed supportive views towards the commission’s role in addressing allegations of interference in FICAC investigations by politicians, highlighting the importance of transparency and accountability in the processes that govern public trust.
