Concerns have been raised by Opposition Leader Inia Seruiratu about the Coalition Government’s failure to utilize provisions under Section 111 of the Fijian Constitution in response to allegations involving senior constitutional officers. He pointed out during an interview that this inaction stands in contrast to previous instances where the government employed these constitutional provisions to address misconduct by high officials.
Seruiratu highlighted that there are processes defined by law to handle such allegations, specifically referencing how the government had previously invoked Section 111 to suspend former senior officials, including the former Commissioner of Police and the Chief Justice. He expressed discontent that similar actions have not been taken regarding current allegations against officials such as Barbara Malimali, appointed by the Judicial Services Commission (JSC), who remains active despite being under investigation—unlike Corrections Commissioner Dr. Jalesi Nakarawa, who was placed on leave.
“The government cannot be selective about when to act,” Seruiratu stated, asserting that it bears the responsibility to ensure justice is pursued following the findings of a Commission of Inquiry report. He emphasized the importance of treating all officials equitably under the same standards and calls for a consistent approach to investigations within government institutions, thereby maintaining public trust.
This call for uniformity in handling investigations illustrates a deeper concern regarding governmental accountability and transparency.
