The iTaukei Land Trust Board (TLTB) has reinforced its commitment to the residents of the Toko lease in Tavua, asserting that there will be no arbitrary removals or dispossessions of those residing on the land. This statement comes in light of an interim injunction issued by the Ba High Court, which restrains the TLTB from surrendering, canceling, or otherwise altering the Toko leases or associated subleases.
The TLTB clarified that the court proceedings aim to establish whether the Board has the authority to unilaterally alter the leases without the consent of the current sublessees. Such injunctions are common as they allow time for all parties to prepare their legal documents for the court’s review, ensuring the status quo is maintained while the case is evaluated.
In previous developments, similar legal discussions have highlighted the ongoing tensions regarding land tenure in Fiji, particularly concerning the 999-year leases that many tenants occupy. The TLTB, under the leadership of CEO Solomone Nata, has emphasized the importance of equitable arrangements and open discussions between landowners and tenants to resolve such disputes amicably.
Nata has been actively engaging with the Toko community to address these concerns, previously assuring tenants that efforts would be made to find a resolution that respects both tenant rights and landowner interests. Notably, recent consultations aimed at clarifying lease agreements have shown a collaborative spirit in working toward sustainable solutions for the affected residents.
This underscores a hopeful outlook as ongoing dialogs are expected to foster trust and cooperation, potentially leading to resolutions that safeguard the rights and livelihoods of the community members. The commitment shown by TLTB to adhere to court orders and engage transparently serves as a promising foundation for a fair and secure environment moving forward.
