The Suva High Court has upheld the conviction and sentence of Kautanagauna Raiqeu, a former employee of Post Fiji Limited, affirming the decision made by the Magistrate’s Court last year regarding serious charges of breach of trust. Justice Thushara Rajasinghe delivered the ruling, emphasizing the severity of the offenses and the absence of mitigating factors in Raiqeu’s case.

Raiqeu was found guilty of one count of conspiracy to defraud and 11 counts of general dishonesty, which culminated in a financial loss to Post Fiji Limited amounting to $193,419.70 between June and October 2010. The appeal was dismissed, with Justice Rajasinghe highlighting that Raiqeu failed to plead guilty and did not offer any reparations or demonstrate genuine remorse for his actions.

While suspended sentences may be applicable for first-time offenders under certain conditions, the court found that such terms were not appropriate for Raiqeu due to the nature of his crimes and the lack of contrition. The judgment confirmed that the Magistrate was correct in omitting any non-parole period, considering the delays present in the case proceedings.

Following the court’s decision, Raiqeu has been granted a 30-day period to file an appeal against this ruling. This situation reflects ongoing efforts to address corruption and misconduct in Fiji, mirroring trends seen in other recent high-profile cases within the judicial system. The determination of the courts to maintain accountability may instill greater public trust in governance and justice in the region.
