Lawyers representing the Fiji Independent Commission Against Corruption (FICAC) and Sarika Devi Raj, a former finance officer of the Republic of Fiji Military Forces (RFMF), have been allotted additional time to address issues concerning necessary disclosures in Raj’s ongoing legal matter. This was discussed during a recent session at the Suva Magistrate’s Court, where Raj sought to modify her bail conditions, asking to eliminate her requirement to report to the FICAC office.
Raj faces serious allegations of having engaged in actions leading to an improper gain of $182,404.99 between September 20, 2019, and June 19, 2020. The charges stem from her purported failure to disclose her ownership of Maleka Investment, an active vendor for the RFMF, which allegedly compromised the rights of the military organization.
During the proceedings, Raj’s attorney, Mohammed Saneem, asserted that FICAC misled the court regarding the execution of a search warrant and argued that needed documentation as requested by the RFMF’s legal director was not adequately supplied. He raised critical questions about jurisdiction, challenging whether the RFMF or the court should hold the primary authority in this case.
In her defense, FICAC lawyer Lavinia Ravuikadavu denied misleading the court. She explained that while she executed the search warrant, FICAC has over 150 manuals and instructions to navigate and needed specific requests from Saneem regarding which documents were required. She confirmed that the communication outlining this position was sent on December 17, 2024.
Magistrate Pulekeria Low emphasized the importance of FICAC providing the necessary documentation, as they are the charging party. Saneem has been granted 14 days to file a further request for documents, followed by another 14 days for FICAC to respond. Both parties are scheduled to return to court on January 23.
