The Judicial Services Commission (JSC) has taken significant steps toward addressing the recent High Court ruling regarding the appointment and removal of the Commissioner by deciding to invite former FICAC Commissioner Barbara Malimali, her legal representative, the Solicitor General, and counsel for the Prime Minister to a series of discussions. This move comes on the heels of a court decision last week, which clarified that the authority to advise the President on such matters lies solely with the JSC, not the Prime Minister.
The JSC is committed to acting promptly and effectively in resolving the Malimali situation. Following the consultations with the aforementioned parties, the Commission intends to collaborate with Acting Attorney-General Siromi Turaga to formulate independent recommendations that will be presented to the President.
