Fiji’s Corruption Inquiry Unfolds: What Lies Ahead for FICAC’s Leadership?

The Commission of Inquiry (COI) investigating the appointment of Barbara Malimali as the Commissioner of the Fiji Independent Commission Against Corruption (FICAC) is in full swing, with key developments expected as Prime Minister Sitiveni Rabuka returns to Fiji today. Counsel assisting the COI, Janet Mason, expressed anticipation for a decision regarding the recommendations from King’s Counsel Philip Joseph, who indicated potential authority of the Judicial Services Commission (JSC) to suspend Malimali.

Mason mentioned that discussions have been challenging in the Prime Minister’s absence, but he is set to participate in discussions today and Friday, which are crucial for determining the way forward. The COI had previously sent Joseph’s legal opinion to both the Prime Minister and the President, Ratu Naiqama Lalabalavu.

The commission is wrapping up interviews with key witnesses, with Malimali scheduled for continued questioning. According to Mason, she remains the last of the main witnesses to testify before the inquiry proceeds to other testimonies next week.

The inquiry aims to assess whether Malimali’s appointment was conducted with integrity, fairness, and transparency and to identify any potential improper or unlawful influences during the process. Given the sensitive nature of the topics involved, sessions are being conducted behind closed doors, a decision made to protect ongoing criminal investigations.

This ongoing inquiry serves as a vital step towards promoting accountability and integrity within Fiji’s governance structures. By examining the legitimacy of FICAC appointments, there is a hopeful outlook that the COI will reinforce public trust in governmental processes and lead to necessary reforms that emphasize ethical standards in the public service. The findings from this inquiry could pave the way for a more transparent and accountable governance framework in Fiji.
