A man serving a life sentence for murder has seen his application for constitutional redress dismissed by the Fiji Court of Appeal. Solomoni Qurai is currently incarcerated at the Naboro Medium Corrections Centre after being convicted for the 2006 murder of Mohammed Azim Khan during a robbery.

Qurai’s appeal cited section 199 of the Constitution and certain sections of the Fiji Corrections Service (Amendment) Act, seeking a legal interpretation related to his case. He claimed to have served 18 years in prison and expressed discontent over the Mercy Commission’s rejection of his pardon application. However, the court noted that he failed to provide supporting evidence for his claims.

Justice Daniel Goundar, presiding over the case, remarked that despite acknowledging the Mercy Commission’s decision, he found no grounds to allow Qurai’s application for constitutional redress. He considered the application to be without merit, labeling it as frivolous and vexatious. Justice Goundar indicated that any future self-filed applications for redress would require prior approval from a high court judge.
