Tenants of Toko, Tavua, who hold 999-year leases, are poised to legally contest a directive from the iTaukei Lands Trust Board (TLTB) that demands the surrender of their lease documents in return for a new 99-year agreement. Spokesperson for the tenants, Satish Chandra, indicated that they have obtained legal counsel to challenge the notice, which was issued on January 18 and set to expire on February 18.

Chandra emphasized that the existing leases are valid, stating, “Why should we surrender it when it has the TLTB stamp on it and every person that has the same legal document.” He noted that as of now, no tenants have complied with the request to surrender their leases, and they have been advised to hold their ground as they prepare for a court challenge.

The tenants maintain that their lease agreements include defined payment amounts, and any discussions regarding annual payments should adhere to the current lease terms. “We don’t want to disrespect anyone, especially the landowners, but right now we have legal documents with clear terms and conditions,” Chandra added.

In response to the situation, the TLTB announced that the initial 30-day notice has indeed been extended for another month. However, inquiries sent to TLTB General Manager Solomoni Nata, as well as questions directed at Finance Minister Biman Prasad regarding compensation, have not been answered, leaving tenants in a state of uncertainty.

This situation underscores the ongoing complexities of land tenure in the region and highlights the importance of legal and equitable agreements between landowners and tenants. The tenants’ determination to seek legal resolution reflects their commitment to uphold what they believe are their rightful entitlements under existing agreements.
