In a recent ruling by the High Court, Justice Dane Tuiqereqere refused a third bail application for Apisai Madigibuli, who stands accused of the murder of his pregnant wife, Kitiana Baravilala. The decision came amidst concerns over the potential threat Madigibuli poses to the community and the victim’s family.
Madigibuli, alleged to have fatally stabbed his wife on April 25 last year, sought bail to access the internet and phone for case preparation, as well as to find employment to support legal defense and his children. However, the State strongly opposed the application. Justice Tuiqereqere noted the delay in the case was due in part to Madigibuli’s own actions. After dismissing his counsel as the trial was about to begin, he chose to represent himself and requested additional time for preparation.
Observing that the accused remains a community risk if released, the judge reiterated previous concerns expressed in a November 2024 ruling when initially denying bail. The concerns align with the prosecution’s previous objections, which highlighted Madigibuli’s prior convictions and recent release from prison the previous December. With these factors in mind, the court continues to regard him as a high-risk individual who might not adhere to bail conditions or return for trial if granted release.
The case has now been adjourned to September 23 for further proceedings. As matters develop, the court remains focused on balancing the elements of justice and safety, ensuring that both legal and community concerns are adequately addressed in the handling of this serious and distressing case.
