The Lautoka High Court has handed down a one-year imprisonment sentence, fully suspended for three years, to two 16-year-old boys after they admitted to charges of aggravated burglary and theft. This incident occurred on August 18, 2023, when the young offenders broke into the home of an elderly couple in Votualevu, Nadi, stealing $15 in cash and clothing valued at $250.

Justice Aruna Aluthge, during the ruling, highlighted the growing trend of burglaries in Fiji and emphasized the importance of deterrent sentencing. Nevertheless, he acknowledged the minimal harm caused in this case due to the low value of the stolen items, the absence of violence, and the offenders’ young age. The judge described the burglaries as opportunistic, lacking premeditation or sophistication, and commended the juveniles for their early guilty pleas and the time they had spent under welfare supervision.

In his statement, Justice Aluthge said that considering their age, remorse, cooperation, and the necessity for rehabilitation, a suspended sentence was the correct approach. Over the three-year suspension period, the juveniles will be placed on probation under the guidance of a welfare officer.

This decision aligns with recent instances where young offenders received suspended sentences for less severe crimes, indicating a judicial system keen on balancing accountability and the potential for rehabilitation. These cases reflect a growing recognition of the need to support young people in making better choices for their future, fostering hope for their reintegration into society.
