Currently, businesses are not held fully accountable for the safety of their customers in preventing violence on their premises. Attorney-General Graham Leung has highlighted that section 72 of existing legislation mandates nightclub licensees to prevent drunkenness and disorderly behavior within their venues.

The recently revised Liquor (Amendment) Act 2023 updated the hours for the sale and supply of alcohol, but also retains provisions to address potential violence. According to Mr. Leung, licensees are prohibited from selling alcohol to patrons who have already consumed a reasonable amount, and those who violate this law may face fines of up to $500. Specifically, it is illegal for licensees to serve alcohol to individuals who are already intoxicated, and it is also an offence to attempt to purchase alcohol for someone who is drunk.

Mr. Leung emphasized the necessity for stricter enforcement of these existing laws to combat alcohol-related issues in nightlife settings, suggesting that the current fine amounts may need to be increased to more effectively deter establishments from tolerating irresponsible behavior. Furthermore, he suggested the government might consider reviewing standards within the security industry to enhance safety measures.

The Attorney-General is planning to meet with the Central Liquor Board members, who provide advice on liquor policy, to discuss how current laws can be strengthened. Their insights will be critical in shaping future legislation aimed at improving safety in venues serving alcohol.
