Employers who operate on Christmas Day, Boxing Day, and New Year’s Day are urged to ensure that their workers receive the correct public holiday pay entitlements as mandated by law. Agni Deo Singh, the Minister for Employment, Productivity, and Workplace Relations, has reiterated the importance of compliance with the Employment Relations Act 2007, particularly Section 67.
According to Singh, workers who do not attend work on a public holiday are entitled to receive their regular pay for the hours they would have normally worked. For employees required to work during these public holidays, the pay rate is significantly higher; they are entitled to receive double their normal wages as specified in Section 67(2) of the Act.
Additionally, Singh clarified that those who do not work on a public holiday but have worked the day before and after are still eligible for regular public holiday pay. However, if an employee cannot work on the working day before or after a public holiday, they must provide a valid reason or a medical certificate to qualify for public holiday pay.
The Minister emphasized that both employers and employees must have a clear understanding of these provisions to ensure fair treatment, prevent disputes, and maintain harmonious relationships in the workplace. This forthcoming holiday season serves as a crucial time for employers to uphold these rights and foster a positive work environment.
