Former parliamentarian Niko Nawaikula’s appeal concerning the High Court’s decision to dismiss his constitutional redress application is scheduled for hearing soon. This matter was discussed in front of Justice Pita Bulamainaivalu, who set the hearing date for February 14, 2024.
Earlier this year, Mr. Nawaikula sought constitutional redress related to a magistrate’s actions, claiming that the late former Chief Justice Kamal Kumar had unfairly directed the matter to the High Court. However, this application was rejected, and Mr. Nawaikula was ordered to pay $2,000 to the Attorney-General’s office, while the FICAC, which had an interest in the case, was not awarded costs due to the specifics of the situation.
Justice Bulamainaivalu stated that Mr. Nawaikula’s intention to appeal to the Court of Appeal presented alternative remedies to his constitutional redress action, showing that it could be considered an abuse of the court process.
All involved parties are required to submit their documents by the end of the day on January 13, 2024.
