The High Court in Suva has discontinued legal proceedings against 26-year-old Jotame Ratabua, who had been accused of murder. Prosecutor Zenith Zunaid filed a nolle prosequi last week, with the approval of Acting DPP Nancy Tikoisuva. The decision to drop the charges was made during a court session before Justice Thushara Rajasinghe, where it was explained that the prosecution had encountered issues that warranted discontinuation of the case.

Ratabua faced allegations of unlawfully striking 24-year-old Simione Ravaga Koro multiple times with a piece of timber, resulting in Koro’s death on October 23, 2022. While discussing the case, Justice Rajasinghe noted that a nolle prosequi could have been filed earlier, which might have spared the court from unnecessary proceedings, as the case was already set for a month-long trial.

Zunaid emphasized that pursuing the prosecution was no longer in the interests of justice, indicating that new findings had emerged since the initial charging. This case adds to the ongoing legal narrative in Fiji, which has seen several instances of serious violence leading to criminal charges.

The discontinuation of Ratabua’s case suggests an adherence to the principles of justice, allowing for cases to be appropriately evaluated as new information develops.
