The High Court has sentenced a man to 14 years and 10 months in prison for the horrific crime of raping and sexually abusing his then 11-year-old stepdaughter over a period of four months in 2022. Justice Waleen George imposed a non-parole period of 12 years and 10 months for the 43-year-old man, who was found guilty of two counts of rape and one count of sexual assault on March 17.
During the period from January 1 to April 1, 2022, the man committed these acts while the girl’s biological mother worked night shifts, indicating a serious breach of trust. In his ruling, Justice George emphasized the gravity of the betrayal, stating, “You should have protected her but instead you breached that trust. This is a serious breach of trust case.” He highlighted that the accused had exploited his position of authority and power to engage in sexual misconduct with the young victim, thus robbing her of her innocence.
The victim’s impact statement revealed the profound trauma she experienced as a result of the abuse, leading her to withdraw from her studies and social interactions. She expressed feelings of hopelessness and deep depression, contrasting her once-proud sense of chastity with her current state of despair.
In his defense, the accused expressed remorse for his actions and mentioned his obligations as the family’s sole breadwinner, caring for his elderly parents. The court initially set a sentence of 16 years, but this was mitigated due to his remand period and expressions of regret.
This case draws parallels with other recent convictions involving sexual exploitation where offenders exploited their positions of authority within familial settings.
