A 56-year-old man has been acquitted of raping his seven-year-old granddaughter but has been convicted of the lesser charge of sexual assault.

In a hearing before Justice Usaia Ratuvili, the man was issued a bench warrant for his arrest after failing to appear in court. The incident, which took place on November 25, 2022, occurred while the complainant and her family were residing with the accused for eight months prior. It was alleged that the man attacked the young girl while she was asleep, only stopping when her father called for her.

Justice Ratuvili stated, “I find the State has failed to establish the charge of rape,” leading to the conviction for sexual assault.
