The Judicial Services Commission (JSC) has decided not to comment publicly on the appointment of Acting Fiji Independent Commission Against Corruption Commissioner Lavi Rokoika while the matter is still before the High Court. This decision comes as the legality of Rokoika’s appointment faces legal challenges in court.
Commission Secretary Tomasi Bainivalu emphasized that providing any public explanation, defense, or justification during ongoing proceedings could undermine the administration of justice and jeopardize the integrity of the judicial process. He stated that the JSC will refrain from engaging in legal discussions through the media, adhering strictly to its constitutional responsibilities.
Bainivalu reiterated that the JSC’s role involves making recommendations to the President in consultation with the Attorney-General and emphasizes that public confidence in the judiciary is bolstered when court matters are determined independently, free from external influence. The Commission is committed to fulfilling its responsibilities with fairness, integrity, and independence, ensuring that the judicial process remains credible during this contentious period.
