Inquiry Drama: Will Fiji’s COI Extend its Reach?

The ongoing Commission of Inquiry (COI) into the appointment of Barbara Malimali as Commissioner of the Fiji Independent Commission Against Corruption (FICAC) has now entered its second week. Tanya Waqanika, Malimali’s defense counsel, expressed that while the process has been prolonged, it is thorough and may need further extension due to its complexity.

In an interview, Waqanika refrained from labeling the inquiry a witch hunt intended to discredit her client but emphasized that Malimali remains in good spirits. She noted their mutual support during this challenging period, highlighting that they have attended church together recently.

Chaired by Supreme Court Justice David Aston-Lewis, the primary task of the COI is to determine if Malimali’s appointment in September 2024 complied with legal standards and was untainted by improper influences. The inquiry is particularly scrutinizing any vested interests linked to significant ongoing FICAC cases involving notable public figures, including Members of Parliament and senior civil servants. Key testimonies from influential individuals, such as the Acting Director of Public Prosecutions and former ministers, are expected to significantly contribute to the investigation.

The final report from the COI is anticipated to be submitted to Fiji’s President and Prime Minister by the end of January, marking an important step forward in enhancing the transparency and accountability of governance in Fiji. This inquiry symbolizes a broader commitment to restoring public confidence in government processes.
