The High Court in Suva is set to reconvene today to discuss Tevita Qaqa Kapawale’s ongoing request for the State to provide additional disclosures related to his case. Kapawale faces five counts of murder, along with one count each of attempted murder and criminal intimidation. He appeared before Justice Daine Tuiqereqere, accompanied by his lawyer, Tobia Ravuniwa.

The charges against Kapawale stem from an incident on May 18, 2021, when he reportedly murdered five individuals aboard the FVO Tiro II in Fijian waters. He is also accused of attempting to kill Kaminieli Tucama and intimidating Mitieli Cama, who is 49 years old.

During the proceeding, Mr. Ravuniwa expressed concerns regarding the availability of the necessary disclosures, noting uncertainty about whether his client’s documents were still at the Remand Centre or had been lost. He offered to photocopy the required materials if it posed difficulties for the State.

Additionally, Mr. Ravuniwa attempted to contest the caution interview, but Justice Tuiqereqere advised that this matter had already been addressed and would not be revisited. State prosecutor Triveshni Sharma emphasized the complexities involved, stating that challenging the caution interview would necessitate recalling all witnesses, which could prove unfeasible. She also pointed out that Kapawale had previously declined Legal Aid representation but was now seeking assistance.

Justice Tuiqereqere stated he aims to resolve all pretrial matters before taking his legal vacation.

This legal case highlights critical aspects of the judicial process, particularly regarding the accessibility of legal documentation for defendants.
