The Fiji Law Society has declared the suspension of Barbara Malimali, the Commissioner of the Fiji Independent Commission Against Corruption (FICAC), as unlawful, emphasizing the need for consultation with the Judicial Services Commission (JSC) prior to any such action. In a statement made by FLS President Wylie Clarke, he highlighted that President Ratu Naiqama Lalabalavu’s decision to suspend Malimali was not backed by constitutional authority since the Prime Minister lacks the mandate to advise on the appointments or disciplinary actions related to FICAC officials.

Clarke argued for the significance of maintaining the “separation of powers,” a key principle designed to prevent political interference in the workings of FICAC. The society stressed that the law dictates the President can only act upon the advice of the JSC, making the suspension of Malimali without their guidance invalid. This points to a critical system of checks and balances that aims to uphold the integrity of governmental institutions.

The context of the suspension follows inquiries into Malimali’s conduct, particularly allegations of witness intimidation linked to her prior role. Concerns were raised about the lack of transparency regarding the ongoing Commission of Inquiry’s (COI) findings related to her actions, which extended to the suspension of a key witness within FICAC.

This unfolding legal drama underscores an urgent need for a re-examination of governance structures in Fiji, particularly regarding the authority of the JSC. As questions about the constitutional legitimacy of the actions taken continue to arise, there is hope that this inquiry will catalyze necessary reforms that enhance accountability and restore public trust in Fiji’s institutions.

The situation highlights broader challenges in addressing the complex issues of governance, and it may serve as a pivotal moment to foster improvements in how officials are held accountable. Ultimately, these developments could lead to a stronger framework for integrity within FICAC and similar bodies.
