Women in Fiji, especially those who have experienced gender-based violence, continue to encounter significant challenges in their pursuit of justice, according to the UN Committee on the Elimination of Discrimination against Women (CEDAW). In their recent report, the committee outlined pressing issues such as high financial barriers, limited legal counsel, geographic isolation, and a notable lack of trust in the judicial system and police as critical impediments for women seeking legal redress.

The CEDAW report pointed out that family court processes in Fiji are often drawn out, further delaying justice. The committee also raised concerns regarding the underrepresentation of women in the judiciary and called for enhanced judicial and police training on gender-sensitive investigation techniques to mitigate biases and improve support for female victims.

To address these systemic issues, CEDAW urged Fiji to dismantle financial, linguistic, procedural, and cultural barriers that hinder women’s access to justice. They emphasized the need for the simplification of legal processes and the provision of affordable legal aid, particularly for disadvantaged groups in remote communities.

The committee advocated for more frequent and accessible mobile courts to serve Fiji’s isolated islands and suggested leveraging technology for virtual court proceedings. Additionally, CEDAW highlighted the importance of appointing more women judges to better reflect the population’s demographics and enhance women’s representation in the legal system.

This report coincides with ongoing discussions in Fiji regarding women’s rights and representation. The Fiji Human Rights and Anti-Discrimination Commission has echoed similar calls for reforms, emphasizing the need to improve the empowerment of women and address the rising gender-based violence that has plagued the country.

Although the situation is challenging, there is renewed hope as Fiji prepares to host the Pacific Technical Cooperation Session of the CEDAW Committee, marking a significant opportunity for local voices to address both the progress made and the challenges ahead in advancing women’s rights and gender equality in the region.

The proactive measures being called for not only emphasize a commitment to justice and equality but also highlight a shared vision for a future where women in Fiji can feel safe, supported, and empowered.
