Seven parties participating in the 2013 Constitution hearings have submitted their written arguments, marking a significant step in the ongoing legal discourse surrounding constitutional reform in Fiji. Among the included groups are the People’s Alliance, National Federation Party, and Social Democratic Liberal Party. The factions led by Ioane Naivalurua and Inia Seruirattu, the Human Rights Commission, and the Fiji Law Society also contributed their submissions.

Notably, the Unity Fiji Party and the Fiji Labour Party have yet to propose their written arguments. Unity Fiji has requested a rephrasing of a crucial question regarding the legitimacy of the 1997 Constitution, while the Labour Party is reviewing its stance with input from an overseas expert. Both are expected to finalize their submissions by the upcoming Tuesday deadline, adhering to the court’s strict timeline.

This legal inquiry, initiated by the Cabinet, seeks clarity on the amendment processes outlined in Sections 159 and 160 of the 2013 Constitution. Concerns raised during these proceedings indicate that the existing framework could create formidable barriers to meaningful reform.

The case is scheduled for live streaming from August 18 to 22, after which the Supreme Court will deliberate with a judgment expected by September 5. This timeline reflects the court’s commitment to a transparent legal process and the importance of public engagement regarding constitutional amendments.

Previous articles have highlighted the ongoing dialogue surrounding constitutional reform in Fiji, emphasizing the need for an inclusive political framework that aligns with the desires of the populace. The active participation of various political and civil entities in these hearings showcases a community effort toward better governance, enriching democratic principles.

Given the proactive measures taken by the government and the diverse representation in the proceedings, there is optimism that these discussions may soon yield significant legal reforms, fostering an environment conducive to public participation and representation. This momentous case underscores a hopeful trajectory toward a more responsive and adaptable governance system in Fiji.
