A landlord has received a suspended sentence from the Nasinu Magistrates Court for failing to maintain proper records and provide necessary information, highlighting important legal requirements in the rental sector. The charges relate to breaches of the Commerce Commission’s Rent Increase Restriction Orders enacted in 2016 and 2017.
During the trial, the court observed that the offender displayed a lack of genuine remorse. Despite considering the landlord’s personal circumstances, the court stressed the importance of accountability and the need for deterrence against similar violations in the future. Consequently, the Resident Magistrate recorded convictions on both counts, imposing an aggregate sentence amounting to one year and two months’ imprisonment, which has been suspended for a two-year period.
Senikavika Jiuta, Chief Executive of the Fijian Competition and Consumer Commission (FCCC), expressed her satisfaction with the court’s decision, underscoring the critical role the FCCC Act plays in regulating landlord and tenant relationships. She stated, “It is a strict legal requirement for landlords to maintain proper records and to provide information to the regulator when requested. This case serves as a firm reminder to all landlords that neglecting these lawful duties has serious legal consequences.”
Jiuta reaffirmed the FCCC’s dedication to ensuring transparency in the rental market and reiterated that the Commission would continue to take firm actions against those who violate consumer protections through inadequate reporting and record-keeping. The FCCC also calls upon all landlords to ensure their documentation is accurate, current, and in compliance with legal requirements. Consumers are encouraged to report any discrepancies in their rental agreements or any suspected violations of rent-freeze orders, fostering a fair and law-abiding rental environment for all.
