Discussions are ongoing regarding a proposed settlement concerning the Judicial Services Commission’s application against the Commission of Inquiry into the appointment of the former Commissioner of the Fiji Independent Commission Against Corruption (FICAC). The JSC is requesting that the court annul the findings and recommendations associated with the inquiry that examined Barbara Malimali’s appointment as FICAC Commissioner, along with seeking other specific declarations.

The case was mentioned today in court but has been adjourned until the following Tuesday. Isireli Fa is representing the JSC in these proceedings, while Justice David Ashton Lewis is being defended by Hemendra Nagin.

Despite the complexities involved, there is hope that a resolution can soon be reached, which may provide clarity on this contentious issue within Fiji’s judicial landscape.
