Concerns regarding comments made by Tanya Waqanika, a lawyer based in Suva, were raised by the prosecution during her ongoing criminal proceedings in the Suva Magistrate’s Court. Senior prosecutor Joseph Work highlighted these issues before Justice Siainiu Fa’alogo Bull, prompting note in the court record.

Justice Bull is overseeing Ms. Waqanika’s application to permanently halt her lower court proceedings, where she faces a charge of publicly opposing a political party under the Political Parties Act. This charge underscores the legal complexities surrounding political expression in the region.

In response to the prosecution’s concerns, defense attorney Barbara Malimali presented the central argument of their application, which questions the legitimacy of the Acting FICAC Commissioner Lavi Rokoika’s appointment. Ms. Waqanika seeks a judicial declaration stating that Ms. Rokoika’s appointment was illegal, null, and void, indicating a significant procedural contention that may have implications for governance and legal standards in Fiji.
