The Nadi Magistrate’s Court has denied the request of Zarin Khan, former president of the Fiji Institute of Accountants, to lift a stop departure order currently imposed on him. This order was established by FICAC Commissioner Barbara Malimali last year as part of an ongoing investigation by the Fiji Independent Commission Against Corruption.
Mr. Khan approached the court seeking permission to travel for medical reasons, but Magistrate Semi Babitu ruled that the Commissioner acted lawfully in issuing the stop departure order. He emphasized that the court did not have jurisdiction to review the matter, as the authority for such decisions lies under section 13 (1) (e) of the Fiji Independent Commission Against Corruption Act 2007.
Following the ruling, Mr. Khan has been granted a 28-day period within which he can appeal the decision.
