Acting Prime Minister Filimoni Vosarogo has clarified that his recent request to the Solicitor-General was intended for a legal opinion rather than a review of Commission of Inquiry files managed by the Office of the Director of Public Prosecutions (ODPP). This clarification follows criticism from Opposition Leader Inia Seruiratu, who condemned the move as potentially undermining natural justice and the rule of law, claiming that the Solicitor-General is implicated in the findings of the Commission of Inquiry.

Seruiratu expressed concerns that any political pressure exerted on the ODPP could be perceived as interference, emphasizing the importance of maintaining the constitutional independence of this office. In response, Vosarogo accused Seruiratu of misinterpreting his request and labeled the opposition leader’s statements as “false and reckless” accusations regarding political interference with ODPP operations.

The Acting Prime Minister explained that his request was focused on obtaining legal advice about the implications of ODPP decisions on ongoing court cases related to issues arising from the Commission of Inquiry. He noted that this legal guidance was essential for briefing Prime Minister Sitiveni Rabuka when he returned to the country earlier this week as part of standard handover procedures.

Vosarogo assured that the Solicitor-General does not possess the authority to review ODPP files and stressed that decisions made by the ODPP cannot be subjected to administrative review outside of the court system. He reinforced that his request adhered strictly to legal protocols and did not seek to influence the independence of prosecutorial functions.

This incident brings to light the delicate balance between political oversight and judicial independence, underscoring the importance of maintaining integrity within the legal framework while addressing public concerns.
