The Fiji Independent Commission Against Corruption (FICAC) has reaffirmed its dedication to impartiality and evidence-based decision-making. It seeks to assure the public that all investigations and subsequent actions are undertaken without bias, favoritism, or fear.
In response to comments made by Opposition Leader Inia Seruiratu about recent developments involving former Minister for Women, Lynda Tabuya, FICAC clarified that it had received a complaint on April 5, 2024, from the office of the Supervisor of Elections (SOE). The complaint alleged that Ms. Tabuya did not declare her spouse’s income and business affiliations as required by the Political Parties (Registration, Conduct, Funding and Disclosures) Act.
An investigation was initiated by former Acting Deputy Commissioner, Ms. Francis Puleiwai, on April 24, 2024, which confirmed that Ms. Tabuya’s marriage to Mr. Robert Semaan had been legally dissolved in December 2016. Investigators concluded their work and recommended closing the case on August 5, 2024. The case was formally closed by Ms. Puleiwai on August 12, 2024, and the SOE was notified of the closure on September 20, 2024.
FICAC emphasized that neither party was represented by Ms. Malimali during the divorce proceedings while she practiced privately. Seruiratu expressed concerns regarding Commissioner Malimali’s role, suggesting the closure was based on potentially false information and called for further investigation into whether any undue influence from Ms. Tabuya was involved. However, FICAC refuted this claim, clarifying that all actions concerning Ms. Tabuya occurred before Ms. Malimali’s appointment as FICAC Commissioner.
The Commission strongly condemned Seruiratu’s comments for casting doubt on its work and urged the public, including those in positions of authority, to verify facts before making public statements regarding FICAC’s operations.
This development underlines the importance of transparency and accountability in governance. FICAC’s commitment to conducting unbiased investigations is vital for maintaining public trust and ensuring that all political figures adhere to the law. The Commission’s response can serve as a reminder to all stakeholders about the importance of due process and the need to uphold the integrity of public institutions.
