A man in his 50s, a father of two, has been accused of raping his 33-year-old niece during a drinking session and has been granted a non-cash bail bond of $500. The married defendant appeared before Justice Thushara Rajasinghe in Suva, facing a charge of rape related to an incident that reportedly occurred in June at his apartment in Tacirua.

State lawyer Katarina Dugan did not oppose the bail request after completing the necessary surety checks. The defense attorney, Shahlaa Begum, indicated that her client plans to live in Nadi while awaiting further court proceedings.

The court has instructed Ms. Dugan to provide a Domestic Violence Restraining Order to both the accused and the complainant by November 28. Furthermore, Ms. Dugan indicated that the prosecution aims to present three witnesses, including the complainant and the investigating officer. The defense plans to call only the accused as a witness. A hearing is set for April 11 of the following year.

This situation underscores the legal processes in place for addressing serious allegations, ensuring that both the accused and the complainant have their rights considered as the case unfolds. It is a reminder of the complexities involved in legal proceedings and the importance of a fair trial.

In such challenging circumstances, it is crucial for all parties involved to have access to support services and resources, highlighting the importance of community awareness and education on consent and healthy relationships.
