Former President Ratu Wiliame Katonivere recently testified regarding the swift appointment of Barbara Malimali as the Commissioner of the Fiji Independent Commission Against Corruption (FICAC). In his statements, he conveyed that the appointment process was rapid, stating that he reviewed the relevant documentation and proceeded with the signing without delay, as indicated in a Commission of Inquiry (CoI) report released by the government.

Katonivere noted that he first became aware of allegations against Malimali through a letter from acting FICAC Deputy Commissioner Frances Puleiwai dated August 30, 2024. He referred the allegations to the Solicitor General but reported that there was no response. Under questioning, the former President reflected on the pressure of having to make a decision without ample time to seek independent verification or fully investigate the recommendations presented to him.

On September 5, 2024, the same day Malimali’s appointment took effect, Katonivere learned through media reports that she had been arrested. He expressed feelings of distress both personally and for the institution, implying that the circumstances surrounding her appointment were troubling. He also stated that he had not contemplated rescinding her appointment or sought legal advice regarding possible actions, indicating a strong adherence to the recommendations of the appointing bodies.

This situation comes amid a backdrop where the chair of the Judicial Services Commission, Salesi Temo, has publicly asserted that Malimali’s appointment followed proper procedures and was devoid of irregularities, as mandated by the FICAC Act 2007. The rapid turnaround in her appointment coincided with various allegations of misconduct against her, which has led to significant scrutiny over the conduct of those within the commission.

Furthermore, Ms. Pulewai has raised concerns about the timing of Malimali’s appointment and the validity of the allegations against her, suggesting that they may be politically motivated due to her involvement with FICAC amidst an ongoing investigation.

As this complex narrative continues to unfold, it is imperative that all parties involved strive for transparency and integrity within the commission, upholding the principles of justice and accountability in light of the serious allegations being circulated.
