The High Court of Suva has ruled that 18-year-old Rihaal Kumar, currently facing a murder charge in connection with the death of 20-year-old Sharuf Shaakir Khan, undergo psychiatric evaluation. This decision comes after a bail hearing where Justice Daniel Goundar denied Kumar’s bail request, citing concerns regarding the serious nature of the allegations.
Kumar is accused of murdering Khan in an apartment complex on Waimanu Road on July 7. The state, represented by lawyer Bhavna Kantharia, successfully argued for a psychiatric assessment, highlighting Kumar’s prior expulsion from school and the gravity of the charges faced. His legal counsel contended that Kumar, a first-time offender with no history of absconding, should be granted bail. However, the judge determined that the circumstances did not warrant this.
Furthermore, during courtroom discussions, it was mentioned that Kumar’s mother has a history of schizophrenia, which may impact the evaluation process. His lawyers expressed their frustration over not having received necessary disclosures from the state, which adds complexity to the defense preparations.
Kumar’s next court appearance is scheduled for July 29, where he will formally enter his plea. This ongoing case reflects broader societal concerns over violent crime in urban areas, reiterating the importance of community engagement in addressing these significant issues.
As the legal proceedings unfold, there is hope that through thorough assessments and community discussions about underlying causes of violence, a safer environment can be fostered for all residents. Initiatives aimed at violence prevention and mental health support may emerge as crucial components for addressing such challenges in the future.
