Francis Puleiwai, the former Deputy Commissioner of the Fiji Independent Commission Against Corruption (FICAC), has formally requested an investigation into the actions of her successor, Barbara Malimali, regarding alleged misconduct. In her correspondence to the Chief Registrar, Puleiwai specifically pointed to an incident on September 7, when Malimali supposedly issued a Stop Departure Order against her without a proper investigation or adherence to the required legal protocols.

Puleiwai contended that the timing and execution of the Stop Departure Order was questionable, suggesting that it was intended to hinder her ability to leave the country as Malimali worked to build a case against her. She characterized this as a significant misuse of authority, noting the importance of following legal guidelines as stipulated by the law.

She further asserted her belief that Malimali’s complaint against her with the police would not hold up, as her actions taken on September 5 were executed in good faith and were protected under the FICAC Act 2007. According to Puleiwai, Section 10G(1) of the Act provides her with immunity from criminal or civil action concerning those actions.

Puleiwai expressed concern that the Stop Departure Order remains active in the Immigration System, highlighting Malimali’s failure to communicate with the Director of Immigration to have the order rescinded despite procedural errors recognized in its issuance.
