The Biodiversity Beyond National Jurisdiction (BBNJ) Agreement has officially come into force, heralding a transformative era for global ocean governance. This pivotal treaty aims to conserve and sustainably manage marine biological diversity in regions beyond national jurisdictions, marking a significant milestone in international environmental agreements.

The BBNJ Agreement emerged after over two decades of negotiations under the United Nations Convention on the Law of the Sea (UNCLOS), being adopted on June 19, 2023. It stands as the third implementation agreement under UNCLOS, bringing to life a binding legal framework that addresses critical issues including marine genetic resources, equitable benefit-sharing, area-based management tools, environmental impact assessments, and the transfer of marine technology.

The Pacific region has been instrumental in both the development and implementation of this treaty. The Federated States of Micronesia became the first UN Member State to sign the BBNJ Agreement, with Palau securing its position as the first nation to ratify it. As of now, there are 145 signatories and 83 parties to the agreement worldwide, with eight Pacific countries having completed the ratification process, underscoring the region’s commitment to effective ocean governance.

Collaborative efforts spearheaded by the Pacific Ocean Commissioner (OPOC), the Council of Regional Organizations in the Pacific (CROP), and the Pacific Ocean Alliance have provoked extensive initiatives for ratification and implementation of the BBNJ Agreement. Regional workshops and meetings have been held to facilitate understanding and promote localization of the agreement into national laws, further strengthening the framework’s effectiveness.

Pacific Ocean Commissioner Dr. Filimon Manoni praised the agreement’s entry into force as a significant advancement for ocean governance. He noted that while this achievement is commendable, the real challenge lies in the implementation and cooperation among nations to manage their ocean territories comprehensively—both within and beyond national boundaries.

The BBNJ Agreement paves the way for the inaugural Conference of the Parties and strengthens global endeavors to protect the high seas. This historic achievement serves as a remarkable victory for international marine stewardship and highlights the Pacific’s leadership in addressing vital environmental challenges.

With this new legal instrument in place, the global community can work towards ensuring the protection and sustainable utilization of marine resources for generations to come, cultivating optimism for the future of our oceans.
