Apisai Madigibuli, accused of murdering his pregnant wife, Kitiana Baravilala, is currently seeking bail, citing concerns about his health and conditions in the remand center, particularly a fear of contracting HIV. The 27-year-old appeared at the Suva High Court before Justice Dane Tuiqereqere to discuss his bail application. While he opted for legal representation by Paula Gade from the Legal Aid Commission for the broader case, he initially represented himself in the bail matter.

Madigibuli is alleged to have fatally stabbed Baravilala, who was six months pregnant, on July 28 last year in an apartment complex in Suva. During the bail hearing, Prosecutor Monisha Naidu submitted an affidavit from the Fiji Corrections Service. However, Justice Tuiqereqere indicated that the affidavit failed to address his queries regarding the spread of HIV in the facility and any preventative measures in place.

Additionally, further arguments against prosecution pointed toward Madigibuli’s criminal history, including prior convictions and a relatively recent release in December 2023, raising concerns about his reoffending and potential risks to the community if released on bail. The judge has allowed Madigibuli until May 20 to engage a new lawyer and extended the discussion regarding his substantive case to June 3.

This case underscores the complexities and risks involved in bail decisions, especially concerning individuals with prior criminal records and ongoing court proceedings.
